Probate Courts;

Are any of you charging Nursing Homes and agencies that are transferring wards to your court? If so, how much?

Also, when it comes to guardian complaints, do you allow the complaints and if so are you charging when they are filed?

Hello, Lisa. Happy New Year!
Are any of you charging Nursing Homes and agencies that are transferring wards to your court? If so, how much?
We do not charge the nursing homes nor do we locate guardians for them.
Also, when it comes to guardian complaints, do you allow the complaints and if so are you charging when they are filed?
We do file the complaints and give notice to the guardian that one has been filed and give them 10 days to respond. We charge $5 even if the ward is indigent.

Good morning. In Sandusky County we do not charge to transfer a Ward to our county. WE do contact the other Court and request that all the filings are up to date, nothing is currently late, before we accept the transfer. We also do not locate guardians, but, there has been a special circumstance where we had to find a guardian.

We accept complaints and we do not charge for them. I'm not sure you can refuse a complaint. If anyone knows anything on that I would be interested. Our process for complaints is:
We receive the complaint, docket it in the guardians log. (i.e. a complaint can be a letter of concern or a formal motion, in our Court.)
It goes up for the Judge to review with the Notice to Guardian and Maker of Comments or Complaints-Disposition of comments or Complaints form.
After the Judge has made his decision, set for hearing, no further action, etc., we docket the disposition and send a copy of that, along with the complaint to the guardian, ward, and person filing the complaint. If the Judge request a hearing to be set we would also include a notice of hearing.
